Definitions

Buyer: The individual or organisation that buys or agrees to buy Goods from the Seller.

Contract: The Contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these conditions.

Goods: The articles that the Buyer agrees to purchase from the Seller as set out on the order.

Seller: Tulip Tree Antiques.

Terms and Conditions: The terms and conditions set out in this document.

 

Ordering and Delivery: When you place an order with Tulip Tree it will be deemed that you have read, understood and agreed to these terms and conditions.

We are thorough in ensuring that information and photographs relating to each product are as accurate as possible. As many of our items are made by hand, unique or vintage, variations in colour, texture, size and pattern will occur.

The Buyer shall be responsible for the arrangement and cost of packaging and delivery. The Seller will endeavour to advise and assist in the choice of delivery method and required packaging. The Seller may also be able to carry out deliveries local or otherwise at an agreed rate for the distance.

The Seller will try to meet any agreed delivery times, however the Seller shall not be liable for any losses, cost, damages, or expenses incurred by the Buyer, or of any Third Party, arising from any failure to meet any estimated delivery date.

Delivery of the Goods shall be made to the Buyer’s delivery address specified in the order and the Buyer shall make any arrangements necessary to accept delivery.

 

Prices and Payment: The price of the Goods shall be that stipulated on the website.

Payment for all Goods (& Delivery) must be made in advance by Pay Pal, bank transfer, cash or cheque at time of ordering.

 

Rights of Seller: The Seller reserves the right to update prices on the Website.

The Seller reserves the right to withdraw any goods from the Website at any time.

 

Damages and Returns: The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller in person, by email or by phone, as soon as possible, if the Goods are damaged or do not comply with any of the Contract.

If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.

Where a claim of defect or damage is made by The Buyer and agreed by The Seller, the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to replacement goods or full refund, excluding delivery or postal costs.

Unwanted Goods must be returned by the Buyer at the Buyer’s expense within 7 days from delivery in original condition and should be adequately packaged and insured for the return journey as we cannot refund items broken or lost in transit. The Buyer will receive a full refund of all monies paid for the Goods (excluding delivery charges).

 

Limitation of Liability: The Buyers use of this website and any information which it contains is entirely at the Buyers risk for which the Seller shall not be liable. It shall be the Buyers responsibility to ensure that any products, services or information available through this website meets the Buyers specific requirements.
